1. Acceptance of Terms

By accessing or using CloudShare ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on our website. Your continued use of the Service after any modifications constitutes your acceptance of the revised Terms.

2. Description of Service

CloudShare provides a cloud-based file sharing and storage platform that allows users to:

  • Upload, store, and manage files on our platform.
  • Share files with others through unique share links.
  • Connect to and utilize third-party cloud storage services including Google Drive, Telegram, and FTP servers.
  • Upload files remotely via URL (remote upload).
  • Download files from Telegram channels and groups.
  • Preview files directly in the browser.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

3. User Accounts

3.1 Registration

To use certain features of the Service, you must register for an account. When registering, you must provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Account Responsibilities

  • You must not share your account credentials with others.
  • You must notify us immediately of any unauthorized use of your account.
  • You are responsible for all content uploaded and actions taken through your account.
  • You must not create multiple accounts for malicious purposes.

3.3 Account Termination

We may suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise objectionable. You may terminate your account at any time by contacting us or through your account settings.

4. Acceptable Use Policy

You agree not to use the Service for any of the following purposes:

4.1 Prohibited Content

  • Uploading, storing, or sharing content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
  • Uploading content that infringes on the intellectual property rights of others, including copyright, trademark, or patent rights.
  • Uploading malware, viruses, or any code designed to harm, disrupt, or gain unauthorized access to systems.
  • Uploading content that contains personal information of others without their consent.
  • Uploading content that promotes violence, terrorism, hate speech, or discrimination.
  • Uploading pornography, adult content, or sexually explicit material.

4.2 Prohibited Activities

  • Attempting to gain unauthorized access to other users' accounts, files, or our systems.
  • Using the Service to distribute spam, phishing, or unsolicited communications.
  • Using automated tools (bots, scripts) to abuse the Service, unless through our authorized API.
  • Reselling or redistributing the Service without authorization.
  • Interfering with or disrupting the Service's infrastructure or other users' experience.
  • Using the Service to circumvent any security measures or access controls.

4.3 Rate Limits

We enforce rate limits on uploads and downloads to ensure fair usage and system stability. Exceeding these limits may result in temporary restrictions on your account.

5. File Storage and Management

5.1 Storage Limits

Each user is allocated a default storage limit. You can view your current storage usage in your dashboard. Files that exceed your storage limit may not be uploadable until you free up space or your limit is increased by an administrator.

5.2 File Responsibility

You are solely responsible for the files you upload, store, and share through the Service. We do not monitor, review, or endorse user files, but we may remove files that violate these Terms or applicable laws.

5.3 File Deletion

You may delete your files at any time through the dashboard. Deleted files are permanently removed from our servers and any connected cloud storage within 30 days. Shared links to deleted files will no longer function.

5.4 Third-Party Cloud Storage

When you connect third-party cloud storage services (Google Drive, Telegram, FTP), your files are subject to those providers' terms of service and policies as well. We act as an intermediary and do not control third-party service availability, policies, or data handling practices.

6. Intellectual Property

6.1 Our Rights

The Service, including its original content, features, and functionality, is owned by CloudShare and is protected by international copyright, trademark, and other intellectual property laws.

6.2 Your Rights

You retain all rights to the files and content you upload to the Service. By uploading content, you grant us a limited license to store, process, and serve your content as necessary to provide the Service, including enabling file sharing and preview functionality.

6.3 DMCA and Copyright

We respect intellectual property rights. If you believe that content on our Service infringes your copyright, please contact us with a detailed notice including the infringing content's location and proof of your ownership. We will take appropriate action, including removal of infringing content when verified.

7. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Warranties that the Service will be uninterrupted, timely, secure, or error-free.
  • Warranties that the results obtained from the use of the Service will be accurate or reliable.
  • Warranties that any errors in the Service will be corrected.

8. Limitation of Liability

In no event shall CloudShare, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:

  • Loss of profits, data, use, goodwill, or other intangible losses.
  • Damages resulting from unauthorized access to or use of our servers or any personal information stored therein.
  • Damages resulting from bugs, viruses, or similar malicious code transmitted through the Service.
  • Damages resulting from errors, mistakes, inaccuracies, or omissions in any content.
  • Damages resulting from the interruption, suspension, or termination of the Service.

9. Indemnification

You agree to defend, indemnify, and hold harmless CloudShare and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with:

  • Your access to or use of the Service.
  • Your violation of these Terms.
  • Your violation of any rights of another party, including intellectual property rights.
  • Any content you upload, store, or share through the Service.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which CloudShare operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation, and if necessary, through the courts of the applicable jurisdiction.
